1. Introduction
1.1 This Privacy Policy (Policy) governs how Research and Education Advanced Network New Zealand Limited (REANNZ, we, us, our) will collect, use, store and disclose the personal information we collect about you. Your privacy is important to us, and we are committed to protecting your personal information in accordance with the Privacy Act 2020 (Privacy Act). This Policy is also our Information Gathering Transparency Statement, for the purposes of Public Service Commission’s Model Standards for Information Gathering and Public Trust (the Information Gathering Model Standards).
1.2 If you disclose personal information, we will only use, share or transfer that personal information in accordance with this Policy. This Policy applies to information gathered by us, our contractors, or any other third parties engaged by us.
2. What is personal information?
2.1 In this Policy, personal information has the meaning given to it in the Privacy Act.
3. Updates to our Privacy Policy
3.1 We may review this Policy from time to time, including to ensure we are keeping up to date with changing laws and our operations. We will amend and update the Policy by posting a revised version on our website (reannz.co.nz) (the Site).
3.2 By providing us with your personal information, you accept the terms of this Policy and any updates to our Policy. If you do not accept the updates to our Policy, you must not provide us with any further personal information.
4. When do we collect personal information about you?
4.1 If you choose to disclose personal information to us, we will collect information when you:
(a) subscribe to our mailing list for updates;
(b) interact with us or provide feedback to us;
(c) provide information in relation to a recruitment process;
(d) interact with any of our social media channels; and
(e) otherwise provide any other information to us, including through our Site, over email or the phone or in person.
5. What kind of personal information do we collect?
5.1 The personal information we collect may include:
(a) your personal and contact details (including, but not limited to, your full name, email address, physical address and phone number);
(b) information related to recruitment (including, but not limited to, your job profile information, CV information and references);
(c) records of your activity when you use our Site and/or social media channels;
(d) recordings of telephone calls and copies of other communications with or from you;
(e) your activity and notification preferences on our Site;
(f) information we create in the course of our relationship with you; and
(g) information from your computer or device in relation to your use of our Site or social media channels if such information is identifiable to you, including but not limited to the IP address, domain name, browser type, activity logs, cookie and browser identifiers and location identifiers (for more information about website analytics see below).
5.2 We collect personal information in different ways, but most of the information we collect directly from you.
5.3 At times, we may collect information about you from a third party that you have authorised, or as permitted by law.
5.4 If we indirectly collect your personal information and you have not already been notified about that collection, we will take reasonable steps to notify you, in accordance with the Privacy Act and any amendments to it.
5.5 If you choose to subscribe to receive REANNZ newsletters and relevant updates, or choose to provide feedback during our customer satisfaction surveys, we will use MailChimp and SurveyMonkey to help us manage this process. Appropriate licences are in place to ensure that the information provided is protected. You can request to be removed from our mailing lists at any time, please contact us or select unsubscribe. We will continue to monitor the use of these tools and ensure that they remain safe and reputable places to hold this information. 5.6 If you have provided us with information about another person, you warrant that you are not prohibited by law in doing so. Your obligations under privacy laws may require you to seek permission from the person and/or may mean that you need to tell that person about the disclosure and let them know that they have a right to access their personal information and that we will handle their personal information in accordance with this Policy.
5.7 REANNZ does not have any law enforcement responsibilities, and does not gather any information for these purposes. However, the law sometimes requires us to collect personal information, for example under:
(a) the Telecommunications (Interception Capability and Security) Act 2013 (for the purposes of fulfilling our responsibilities under that Act); and
(b) the Copyright (Infringing File Sharing) Amendment Act 2011 (we maintain a record of the association between IP Address and account holder so we can comply with this Act).
5.8 If we gather information for law enforcement or regulatory compliance purposes, we will comply with the Information Gathering Model Standards.
6. Why do we collect personal information and what do we use it for?
6.1 We collect personal information to:
(a) provide you with products and services you request;
(b) provide you with support, notifications, reminders, in accordance with your notification preferences;
(c) manage our relationship with you;
(d) manage our business and services generally, and for general administrative purposes; and
(e) comply with New Zealand laws and any applicable overseas laws.
6.2 Where you consent to us using your personal information for marketing, promotional, feedback or newsletter communications, you can choose to stop receiving such communications by using the unsubscribe function or contacting us.
6.3 We may use and/or share your personal information in an anonymised aggregate form with others.
6.4 We can also compare and combine any personal information we hold about you with any publicly available information about you, for the purposes set out above.
7. Sharing your information
7.1 We may disclose your personal information:
(a) for the purpose for which it was collected (or a purpose that is directly related to that purpose);
(b) to the third parties we can disclose your information to in accordance with clause 5.7 and/ or 6.1;
(c) to the third party service providers that provide services in relation to our business and services;
(d) to any court, tribunal, and regulatory authority for the purposes of investigating and/or detecting breaches of relevant legislation of New Zealand and/ or contractual terms between you and us;
(e) to any other person or organisation that you have authorised us to disclose your personal information to;
(f) to other government agencies;
(g) to any other person or organisation that we are permitted or required to disclose your personal information by law; and
(h) any other person, if we have your consent.
8. Security of your personal information
8.1 We will store your personal information in accordance with our obligations under the Privacy Act and will take reasonable steps to ensure the security of your personal information. The security of our people and premises is managed in accordance with our health and safety policy and security policy, and in accordance with government procurement standards and government Protective Security Requirements.
8.2 Personal information that you provide to us will generally be held in electronic form on our, or our service providers’ secure servers. We have information security policies and standards and ensure that our third-party contractors have information security policies and standards in place, to appropriately limit access to, and use of, data on those servers.
8.3 Your personal information may be accessed from and/or stored on our third-party service providers servers outside of New Zealand.
8.4 Protecting the personal information of yours that we hold and process is important to us. Our systems are protected by such security safeguards that are reasonable in the circumstances to prevent the loss, misuse and/or alteration of information under our control.
8.5 Our employees and contractors (including third party contractors) that process information on our behalf have confidentiality obligations in relation to your information (including personal information) accessed by them.
8.6 Although we take reasonable steps to ensure personal information held by us (or on our behalf) is protected and held securely, we do not make any warranties in relation to the security of any information you disclose or transmit to us and we are not responsible for the theft, destruction, or inadvertent disclosure of your personal information where our security measures have been breached. Any transmission of personal information is conducted at your own risk.
9. Access and correction of your personal information
9.1 You agree that any information you give to us will be accurate, correct and up to date.
9.2 Subject to any exceptions in the Privacy Act, you have a right to know what information we hold about you and to request that we amend it if it is incorrect. If you’d like to receive a copy of the personal information we hold about you, or to correct that information, please contact us. If we are not willing to correct errors that you have identified in your personal information, you may request that we take reasonable steps to attach a statement to the personal information noting the correction sought.
9.3 We will only retain your personal information for as long as it is required to achieve the purposes set out in this Policy or as otherwise required or permitted by law, including the Public Records Act 2005.
10. Third party sites and services
10.1 Our Site uses third party software and services in order for us to operate. These third parties may have their own terms and conditions, and privacy policies. We encourage you to read these documents.
10.2 We may link or reference to other websites. Our Privacy Policy does not apply to any other websites and we take no responsibility for the privacy practices of other websites.
11. Public records, official information and parliament
11.1 Materials containing your personal information may constitute public records and be retained to the extent required by the Public Records Act 2005. We may also be required to disclose those materials under the Official Information Act 1982, to a Parliamentary Select Committee or to Parliament in response to a Parliamentary question.
12. Cookies and analytics
12.1 The Site can be viewed without the need to disclose any personal information to us. However, our Site uses cookies, and we may use analytics tools, as set out below. If information generated by cookies or analytics is combined with other information about you and therefore becomes personal information, that information will be treated in accordance with this Policy.

12.2 Our Site generates persistent cookies for the purpose of authentication and monitoring Site usage. A cookie is a small text file that is stored on your device when you access a website. Cookies allow us to recognise your internet browser as you move around our Site.
12.3 By using our Site with cookies enabled you consent to cookies being used. Some of the ways we use cookies include, but are not limited to, customising our Site with your preferences, identifying you for security reasons, analysing trends on our Site, facilitating market research and promotional activities, and measuring the effectiveness of our marketing initiatives.

Website/google analytics
12.5 We may use analytics tools (including third party cookies) to collect information from you. This information may include your IP address, click activity, form requests, and the timing and frequency of your use of our Site.
12.6 We also use Google Analytics to collect data about the use of our Site. We may use Google’s analysis to help us gain a better understanding of our audience demographics and how people interact with our Site. We may disclose the information collected by Google Analytics, in an aggregate, anonymised (not personal) form only, to third parties. When we use Google Analytics, Google’s privacy policy will also apply and the data that is collected and stored on the Google server is governed by Google’s privacy policy.
